Terms and Conditions: Welcome

INTRODUCTION

1. These terms form the basis of the contract between you, the customer, and Save Me A Slice. These Terms, and any other correspondence regarding your order are considered by Save Me A Slice to set out the whole agreement between you and Save Me A Slice for the sale of cakes.

2. Any headings utilised in this Agreement have been inserted for the convenience of reference only and should in no way restrict or otherwise affect the construction of the terms and conditions hereof.

3.    BASIS OF SALE

3.1.      Any samples, drawings, or descriptions provided and any illustrations or photographs contained on the website are displayed solely to provide you with an approximate idea of the cakes they describe and remain the property of Save Me A Slice at all times.

3.2.      Save Me A Slice cannot guarantee the depth of any individual cake. Typically, a 4 inch cakes consist of 3 layers of cake and 6/8/10 inch cakes will consist of 4 layers of cake. Smaller cakes and/or multiple tiers can be requested.

3.3.      It is your responsibility to provide accurate personal information and to update your personal information as necessary to keep it accurate. You undertake that all the details you provide to Save Me A Slice for the purpose of selling and delivering products to you are correct.

4.    OUR CAKES

4.1.      Save Me A Slice confirms that upon delivery, or collection the Cakes, or other goods, shall conform to their description as agreed with you. The cake, or other goods, will be of satisfactory quality and will comply with all food safety, statutory and regulatory requirements in the UK.

4.2.      Save Me A Slice will not be held responsible for customer disappointment of the design or the interpretation of the cake as long as it has been made in accordance with the customer’s pre agreed requirements. It is the customers responsibility to ensure all details previously agreed are correct and meet their exact requirements.

4.3.      The warranty does not apply to any defect in the Cakes, or other goods, which arises from wilful damage, accident or negligence by you (or any third party), if you use/transport/or store the cake in a way Save Me A Slice does not recommend, if you fail to follow our instructions or if you (or any third party) undertake any alteration to the cake, or other goods.

4.4.      Where you provide a reference image for guidance Save Me A Slice will endeavour to ensure that your order matches the image as closely as possible, however, Save Me A Slice cannot guarantee an exact replica of any cake. Where you provide a colour swatch Save Me A Slice will endeavour to match it as closely as possible, however, exact colour matches are not guaranteed.

4.5.      Fresh flowers are not included in the price of any cake design. Where they appear in photographs on the website or social media this is simply for presentation purposes. If you require a cake to be dressed with fresh flowers you must arrange for these to be provided by your florist at your own expense unless previously agreed.

4.6.      Please be aware that some flowers are not suitable for use as cake decorations. It is your responsibility to consult with your florist for details regarding toxicity and suitability for display on items that are to be consumed. Save Me A Slice are not liable for any contamination to cake, or other goods, which may arise from their misuse. Where necessary Save Me A Slice will liaise with your chosen florist regarding the size of cake to be dressed etc.

4.7.      From time to time circumstances may mean that certain ingredients or materials for cakes, or other goods, may become obsolete. Where this occurs Save Me A Slice will endeavour to select close replacement products to minimise any impact on the agreed design of your cake. Save Me A Slice reserves the right to replace items with component parts of equal or better quality without consulting you in advance. Where the replacement will mean a significant change in the appearance or taste of your cake, Save Me A Slice will inform you of this.

4.8.      Your cake may incorporate figures made from sugar paste, fondant icing, or other edible material.  Whilst these figures are predominantly made of edible material we do not recommend that you consume them as they may include dowels or other methods of reinforcement which are not edible.

4.9.      Stacked cakes may contain dowels in each tier and a cake board between each tier to provide support. These should be removed before consumption.

4.10.   Cakes should be served, stored and consumed in accordance with the Cake Care Advice which appears on this website. Save Me A Slice recommends that products are eaten on the day of delivery / collection and cannot be liable for any consumption thereafter. Products placed in a fridge or a freezer or kept for a time longer than 24 hours are kept at your own risk and Save Me A Slice is not liable for any deterioration of products in these circumstances.

4.11.   Cakes, and other products, should be stored away from direct sunlight and sources of heat.

4.12.   All goods purchased from Save Me A Slice remain the property of Save Me A Slice until they have been paid for in full.

5.    ALLERGENS

5.1.      Whilst Save Me A Slice make every effort to accommodate people with allergies, all products are made in an environment where nuts, egg, milk, gluten and other allergens are present. Save Me A Slice cannot guarantee that any product will be entirely allergen free. It is your responsibility to inform Save Me A Slice of the need to specifically cater for any allergy when placing your order.

6.    AVAILABILITY, DELIVERY AND COLLECTION

6.1.      Baking slots book up fast in advance and are offered on a first come first served basis. Availability cannot be guaranteed if other customers have booked their order in advance for the day you require. To avoid disappointment, booking as far in advance as possible is advised as all our products are handmade to order and require time to prepare.

6.2.      All orders may be collected free of charge from Save Me A Slice, Hinckley, Leicestershire by prior agreement and arrangement. Save Me A Slice accepts no responsibility for any damage sustained to the cake, or other product, once it has left the premises.

6.3.      Save Me A Slice may also be able to arrange to deliver your order, but this service will always be subject to availability and distance restrictions may apply. Extra charges for delivery may also be applicable. 

6.4.      If delivery has been requested, Save Me A Slice will deliver the cake on the day agreed to the address provided. Save Me A Slice does not offer specific delivery times but will try to accommodate you where possible. Save Me A Slice will always do everything possible to ensure your items are delivered to you on the agreed date and/or time however, Save Me A Slice does not accept liability for delays and time shall not be of the essence.

6.5.      Where Save Me A Slice agrees with you to deliver your order to an address provided by you, you must ensure that you, or someone chosen by you, is available to accept the delivery.

6.6.      In order for Save Me A Slice to hand over the ordered products upon collection or delivery, the recipient may be asked to sign a declaration confirming that the product/s are in good condition and that the complete order has been delivered.

6.7.      Orders which were due to be collected by you and which you failed to collect on the appointed day/time, or orders which we have taken back to our shop because you were not available to receive the same during the delivery slot agreed for you, will be kept in Save Me A Slice's fridges overnight to comply with Food Safety legislation. Save Me A Slice does not accept liability for any deterioration of your products in these circumstances.

6.8.      If, for any reason, you are unable to collect your order or are unavailable for delivery of your order as arranged, we will retain your order for collection by you/or delivery by us for 24 hours. This is always subject to our availability.

6.9.      If you have ordered a cake to be delivered to a wedding venue, you must provide Save Me A Slice with the venue details in advance. Save Me A Slice will then contact the venue in advance to arrange a mutually convenient time for delivery. If set up/assembly of the cake is required Save Me A Slice will, where possible, take a photograph of the cake before leaving and, where possible, obtain a signature from the venue confirming the cake has been received in good condition. If your chosen venue need to set up the cake themselves, Save Me A Slice will happily provide instructions on how the cake is to be displayed and, where possible, obtain a signature to verify that I have done so. Once the cake has been delivered to your chosen venue, Save Me A Slice does not accept any liability for any damage sustained to the cake thereafter or for any failure to follow the instructions provided.

6.10      Save Me A Slice does not currently provide cake stands. If you require a stand to be used you are responsible for obtaining such stand and providing it to Save Me A Slice in good time to ensure there is no delay to the set up of your cake.

7.    PRICE AND PAYMENT

7.1.      The price to be paid by you for any products will be that quoted by Save Me A Slice except in cases of obvious error. Save Me A Slice is under no obligation to provide the product to you at the incorrect (lower) price if the pricing error is obvious and unmistakeable and could have reasonably been recognised by you as an incorrect pricing.

7.2.      Any quotation provided is valid for a period of 28 calendar days from the day of issue. Cake sizes quoted are in inches and are based on the diameter of the cake.

7.3.      The prices on this website are a guide only and the price of individual projects will vary. The price of your cake, or other product, will be agreed with you prior to Save Me A Slice undertaking any steps to make your order.

7.4.      Guide prices are liable to change at any time, but changes will not affect orders in respect of which a quotation has already been provided which has not yet expired.

7.5.      Save Me A Slice reserves the right to request a deposit whenever you place an order at Save Me A Slice's discretion.

7.6.      Please note all deposits are non refundable and non transferable.

7.7.      The balance must be paid in cleared monies or cash either prior to delivery/collection, or, at the point of delivery/collection. If paying by bank transfer, please allow 3 working days for your payment to clear.

7.8.      No further payment reminders will be sent and it is the responsibility of the client to ensure payment is on time.

7.9.      If payment is not received by the date specified, this will constitute a breach of contract by the client. Where such a breach occurs, Save Me A Slice reserves the right to hold the order until payment is made in full.

7.10.   When payment is late Save Me A Slice accept no responsibility if Save Me A Slice is subsequently unable to purchase the required stock or equipment to make the cake as previously agreed. In these circumstances the cake will be made as close to the agreed specifications as possible with no redress or liability incurred by Save Me A Slice.

8.    CANCELLATION, POSTPONEMENTS AND ALTERATIONS

8.1.      If you notice an error in any order confirmation or description of the product required, you must notify Save Me A Slice at least 48 hours before your order is due to be collected or delivered.

8.2.      If you wish to cancel your order, for any reason, you must notify Save Me A Slice at least 72 hours before the order is due to be collected or delivered.

8.3.      If you wish to add to or change your order, or change the date or time of delivery or collection of your order, then Save Me A Slice will try to  accommodate you, subject to discretion and availability. If you wish to add to or change your order, or change the date/time of delivery/collection, you must notify Save Me A Slice at least 72 hours before the order is due to be collected or delivered.

8.4.      It may not be possible to accommodate any alterations/amendments if they are requested 7 days or less prior to the delivery/collection date.

8.5.      Where alterations are requested following the provision of a quote, Save Me A Slice reserves the right to amend any quote.

8.6.      If you cancel your order more than 90 days prior to the delivery/collection date any deposit will be refunded.

8.7.      If you cancel your order 60-14 days prior to the delivery/collection date any deposit will be forfeited by you and will not be refunded or transferred.

8.8.      If you cancel your order 7 days or less prior to the delivery/collection date then the full balance, as previously quoted, remains payable.

8.9.      Save Me A Slice may, from time to time, decide to waive any cancellation fee. This will always be at Save Me A Slice's discretion. Any decision by Save Me A Slice to waive such cancellation fee does not constitute an agreement, either express or implied, to waive such a cancellation fee on any other occasion.    

8.10.   In the event of a postponement, the payment due remains the same as a cancellation. Subject to availability Save Me A Slice will carry any monies forward to the new date. We will only do this on one occasion and any further postponements will be classified as a cancellation.

8.11.   Save Me A Slice reserves the right to cancel, vary or suspend the operation of this contract if events occur which are in the nature of force majeure including (without prejudice to the generality of the foregoing): fire, floods, storm, plant breakdown, strike, lock outs, riot, hostilities, illness, non-availability of materials or supplies or any other event outside the control of Save Me A Slice, and we shall not be liable for any breach of contract resulting from such an event.

8.12.   In the unlikely event that Save Me A Slice needs to cancel your order any monies paid will be refunded.

8.13.   Save Me A Slice’s liability (both in contract and tort) in respect of defects in goods or services shall be limited to the issue of a credit note in respect thereof, or, granting a refund or other such compensatory measures as Save Me A Slice, at its discretion, considers appropriate in the circumstances and shall be limited to the value of the goods or services giving rise to the claim.

8.14.   Save Me A Slice shall not, under any circumstances, be liable for indirect consequential loss or damage or loss of profits, provided always that these conditions do not exclude or restrict our statutory liabilities.

9.    RETURNS

9.1.      Since taste is a very personal matter and subjective, Save Me A Slice cannot accept the return of any products merely because you do not like the taste.

10.    COMPLAINTS

10.1.      Save Me A Slice takes great pride in the goods that it provide and complaints are very rare.  Due to the care put into each order complaints are taken extremely seriously.

10.2.      Any issues must be bought to the attention of Save Me A Slice with 48 hours of delivery/collection in order to give a fair opportunity to assess the nature of the complaint.

10.3.      Both Parties agree not to post any negative information about the other arising out of this Contract and the provision of any goods / services on any online forum or website without first providing advance written notice of the intended content and providing the other party the opportunity to amicably resolve any issues that may have arisen between the parties.

10.4.      Complaints regarding the decoration of some cakes may, in some circumstances, be easily repaired/rectified/altered, therefore, any errors must be pointed out upon delivery/collection so as to give Save Me A Slice the opportunity to correct them.

10.5.      By handing over payment you are confirming that the decoration is as requested and no further claims can be made. Where a sketch or reference image has been provided, handing over payment confirms that you are satisfied with the likeness of your order and that it is decorated as requested and no further claims can be made.

10.6.      Where you wish to complain about the quality of the cake, or other goods, then the cake, or remainder of the cake/tier, or remainder of the goods must be returned to Save Me A Slice as soon as possible after cutting and within 48 hours of collection/delivery so that Save Me A Slice is able to fairly assess the nature of the complaint.

11.    GENERAL TERMS

11.1.      All designs and intellectual property rights remain the property of Save Me A Slice.

11.2.      Save Me A Slice reserves the right to photograph any order. Save Me A Slice reserves the right to use images of your cake on it's website or social media for any form of advertising including web based promotions, brochures, galleries and competitions.

11.3.      Save Me A Slice advises that you keep a copy of all documentation provided/correspondence between yourself and Save Me A Slice for your own benefit.

11.4.      Please note that Save Me A Slice can only deal with the client who placed the original order. This includes, but is not limited to: cancellation, postponement, alteration, complaints and refunds.

11.5.      This Agreement together with any order confirmation documents, final quotation, or correspondence via any other means including email, phone call or message constitutes the entire agreement and understanding between the parties relating to the order.

11.6.      It is your responsibility to check all details in any order confirmation, or other document, are complete and accurate as any inaccuracies may lead to mistakes in your order.

11.7.      Except as may be expressly stated in this Agreement, it supersedes and cancels all prior agreements, statements, representations, understandings, negotiations and discussions, whether oral or written, between the parties.

11.8.      Each of the parties acknowledges and agrees that by entering into this Agreement it does not rely on any statement, representation, warranty or understanding made prior to this Agreement save to the extent that such statement, representation, warranty or understanding is incorporated into this Agreement.

11.9.      Each of the parties acknowledges and agrees that in entering into this Agreement it has not relied on (or has been induced to enter into this Agreement by) any statement, representation, warranty or understanding made prior to this Agreement. For the avoidance of doubt, nothing in this paragraph excludes any liability for fraudulent misrepresentation.

12.    RIGHT TO VARY THESE TERMS & CONDITIONS

12.1.      Save Me A Slice has the right to revise and amend these Terms and Conditions at any point to reflect changes in market conditions, technology, payment methods, relevant laws, regulatory requirements and/or changes in our system's capabilities.

12.2.      You will be subject to the policies and Terms and Conditions in force at the time that you place an order with Save Me A Slice, unless any change to those policies or these Terms and Conditions is required to be made by law or governmental authority (in which case it will apply to orders previously placed by you).

12.3.      Save Me A Slice may make such revisions or amendments to the terms of this Agreement by posting a new Agreement on our website. It is your responsibility to check the website regularly to determine if any changes have been made. Continuing to use the website and Save Me A Slice's services after such a change will constitute your acceptance of the changes.

12.4.      By reading this Agreement together with Save Me A Slice's Privacy and Cookies Policy and continuing to use this Site you acknowledge that you have read, understood and agree to be bound by the Terms and Conditions of this Agreement and by the Privacy Policy.

12.5.      In the event that any one or more such provisions of this Agreement should be deemed to be invalid/unenforceable, such invalidity/unenforceability shall not affect the validity and enforceability of the remaining valid and enforceable provisions which shall be construed as if such invalid/unenforceable provisions had not been inserted.

12.6.      The parties agree to submit to the non-exclusive jurisdiction of the English courts.
